ARTICLE-3- DECLARATION OF EXPLICIT CONSENT/PERMIT FOR COMMERCIAL COMMUNICATIONS REGARDING PERSONALIZED/COMMERCIAL COMMUNICATIONS

I understand that I can stop receiving commercial electronic communications at any time by opting out through the instructions provided in the messages you send, without needing to provide any reason. Additionally, if my personal data is processed based on my explicit consent, I can withdraw that consent at any time and stop the processing of my personal data.

I consent to the processing of my personal data for personalized/commercial communication as described in the disclosure text above. I also agree to the transfer of my data to third parties with whom ANI KUYUMCULUK TURZ. İNŞ. SAN. FOREIGN TRADE LTD. ŞTİ. has a contractual relationship, and to the sending of commercial electronic messages (via SMS, email, phone, push notifications, mobile apps, and other electronic communication tools) using my current contact information, including any updates I make in the future.

ARTICLE-4- INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The privacy rules and conditions outlined below apply to the protection, confidentiality, processing, use, and communication of information on the WEBSITE, as well as other related matters.

4.1. Necessary measures to secure the information and transactions entered by the BUYER on the WEBSITE have been implemented on the SELLER's system infrastructure, in line with current technical capabilities and based on the nature of the information and transaction. However, as the information is entered from the BUYER's device, the responsibility for taking the necessary precautions—such as protection against viruses and other harmful software—lies with the BUYER to prevent unauthorized access.

4.2. In addition to the permissions and approvals regarding personal data and commercial electronic communications previously granted by the BUYER, the information obtained during the BUYER’s membership on the WEBSITE and purchases may be recorded, stored in physical or electronic archives, updated, shared, transferred, used, and processed, either indefinitely or for a period determined by the SELLER, its affiliated group companies, and any third parties deemed appropriate. This processing is for the provision of various products and services, as well as for purposes related to information, advertising, promotion, communication, sales, marketing, store cards, credit cards, and membership applications. These data may also be shared with relevant authorities and courts when required by law. The BUYER consents to the use, sharing, processing, and transmission of their personal and non-personal information for both commercial and non-commercial electronic communications, in compliance with applicable personal data protection and electronic commerce laws.

4.3. The BUYER may stop the processing of their personal data by contacting the SELLER through the specified communication channels, or by exercising the right of rejection in electronic communications sent to them at any time. Upon the BUYER's clear request, the SELLER will cease processing their personal data and/or communications within the legal maximum period. Additionally, if requested, the SELLER will delete or anonymize the BUYER’s information, except for data that must be retained by law or is otherwise necessary. The BUYER may also, at any time, contact the SELLER through the provided communication channels to request information regarding the processing of their personal data, the recipients of such data, corrections to incomplete or inaccurate information, the notification of such corrections to relevant third parties, the deletion or destruction of data, objections to decisions made by automated systems, and compensation for any damages resulting from unlawful data processing. Requests related to these matters will be processed within the legal maximum timeframes or, if not accepted, the legal grounds for refusal will be explained to the BUYER.

4.4. All intellectual property, industrial rights, and ownership rights related to all information and content on the WEBSITE, including its design, arrangement, revisions, and any partial or full use, shall belong to the SELLER, except for those rights belonging to third parties in accordance with agreements made by the SELLER.

4.5. The SELLER reserves the right to make any changes it deems necessary in the above matters. Such changes shall become effective as soon as they are announced by the SELLER on the WEBSITE or through other appropriate communication methods.

4.6. The privacy and security policies, as well as the terms of use, of any other websites accessed through the WEBSITE shall apply to those websites. The SELLER shall not be held responsible for any disputes or adverse consequences that may arise from the use of those third-party sites.
